SUMMARY:Beyond the Document: Advance Care Planning in Aging Services
DESCRIPTION:Advance care planning is more than completing forms. It is an ongoing process of understanding the older adult’s values\, goals\, and preferences for future healthcare decisions. Additionally\, the Centers for Medicare & Medicaid Services (CMS) sought feedback on how to measure advance care planning’s role in quality care and person-centered care in aging services. This session will explore how those caring for older adults can facilitate meaningful conversations\, engage older adults and their families\, and integrate advance care planning into person-centered care to be ahead of future measures implemented by CMS. \nObjectives\n\nIdentify advance care planning’s role in person-centered\, quality care.\nEstablish strategies for effective communication techniques to engage older adults\, families\, and care teams in advance care planning discussions.\nDevelop practices to integrate advance care planning into routine assessment\, care planning\, and transitions of care across aging services settings.\n\nAbout the Speaker\nCynthia Letsch’s goal for 2026 was to become a certified elder law attorney. The National Elder Law Foundation offers the certification in elder law\, which requires active practice in 13 areas of elder law\, substantial history of specialized continuing legal education\, the support of at least 6 other elder law attorneys\, and a full day of proctored testing over those 13 areas of law. There are approximately 500 certified elder law attorneys in the country\, concentrated primarily on the east and west coasts\, with only about 25 practicing in the Midwest. Her five years of diligent pursuit of this certification paid off earlier in 2026 when she became the only Iowa attorney to become a certified elder law attorney. Cynthia is also the only Iowa attorney invited to join the Special Needs Alliance\, a national non-profit organization providing resources and advocacy for persons with disabilities. There are approximately 200 attorneys admitted to this organization. \nShe is admitted to practice in Iowa\, Nebraska\, Missouri\, the Federal Southern District of Iowa and the Federal District of Nebraska\, and she is a VA accredited attorney. She is a member of many bar associations\, the National Academy of Elder Law Attorneys; the National Elder Law Foundation\, the Special Needs Alliance\, and the Iowa Healthcare Association. \nFor fun\, she loves horses\, playing dress up at the Renaissance festival\, and natural fiber textiles. She invites you all to follow her Facebook page titled Fun with Scarves. \nCEUs\nPENDING: 1 hour – Social Worker\, Administrator\, Nursing\nContact Debbie Klindt for the latest information regarding Missouri continuing education units.

SUMMARY:The HCBS Settings Rule in a Shifting Olmstead Landscape: What Assisted Living & Adult Day Providers Need to Know
DESCRIPTION:More than a decade after CMS finalized the Medicaid HCBS settings rule\, its requirements continue to shape how assisted living and adult day providers design\, deliver\, and document services. At the same time\, the federal legal framework behind community integration is changing quickly. In 2026 the Department of Justice reinterpreted the integration mandate under Section 504 of the Rehabilitation Act and title II of the Americans with Disabilities Act\, as well as the holding of Olmstead v. L.C. and stepped back from its longstanding enforcement guidance\, and in September a federal court in Texas v. Kennedy vacated the community integration provisions of the Department of Health and Human Services’ 2024 Section 504 rule.\nThis session gives providers a high-level walkthrough of the setting rule\, including the qualities every HCBS setting must have\, the added conditions for provider owned or controlled residential settings\, person-centered care planning\, and heightened scrutiny. We will look closely at the provisions that most often raise questions in assisted living and adult day. We will then explain what DOJ’s recent actions and the Texas v. Kennedy ruling do and don’t change\, followed by commentary on what they may mean for state oversight\, Medicaid HCBS policy\, and provider operations. \nObjectives\n\nSummarize the core requirements of the Medicaid HCBS settings rule.\nIdentify the provisions most relevant to aging services provider\, such as residency agreements\, privacy\, control of schedule\, visitors\, access to food\, and community access. Distinguish how modifications must be supported through the person-centered plan.\nDescribe DOJ’s 2026 actions on the integration mandate\, Olmstead\, and the outcome of Texas v. Kennedy\, distinguishing what has changed in federal regulation and enforcement from what remains in law.\nAssess the practical implications for compliance\, state oversight\, and advocacy in their own state.\n\nSpeakers\n\nClarette Yen – cyen AT leadingage DOT org\nGeorgia Goodman – ggoodman AT leadingage DOT org \n\nClarette Yen serves as the Vice President\, Legal Affairs at LeadingAge. She previously spent 21 years as an attorney with the federal government. She started her federal career with the U.S. Department of Labor\, where she drafted and reviewed regulations relating to foreign labor certifications and handled administrative litigation before the Board of Alien Labor Certification Appeals. She continued to develop her regulatory expertise at the U.S. Department of Justice\, where she worked on regulation and guidance implementing the Controlled Substances Act\, Americans with Disabilities Act\, and Section 504 of the Rehabilitation Act. She helped lead Section 504 coordination efforts to ensure consistency in interpretation and enforcement across federal agencies. She concluded her federal career at the Government Accountability Office\, where she provided legal support on performance audits in the areas of human capital\, regulation\, and tax policy. She is excited to continue her work in these areas (in addition to learning new ones) to support LeadingAge’s federal advocacy efforts. \nCEUs\nPENDING: 1 hour – Nursing Home Administrator \n\nContact Debbie Klindt for the latest information regarding Missouri continuing education units.
